Frost Brown Todd is defending Kentucky Utilities Company, a subsidiary ofE.On US LLC, in a lawsuit filed in federal court in Owensboro, Kentucky by OwensboroMunicipal Utilities concerning the parties’ long term power supply agreement which dates to1960. OMU seeks to terminate the contract or have several of its important terms reformed or re-interpreted by the court. The court permitted OMU to early terminate the contract in 2010, a decision which KU will appeal.
