On March 27, 2025, the Kentucky General Assembly passed House Bill 398 over a veto by Governor Beshear. This bill is a notable update to Kentucky’s Occupational Safety and Health Act and will transform how employers statewide ensure compliance with workplace safety and health regulations. Among other things, HB 398 aims to align Kentucky’s occupational safety and health standards with federal standards and forbids state agencies from adopting safety and health standards for private employers that are more stringent that those imposed by Federal OSHA.
