Biography

Alex defends and advises municipalities, law enforcement agencies and private companies  at the administrative, trial court and appellate litigation levels. Alex also has years of experience assisting public and private-sector employers in solving the legal issues they face in the modern workplace.

In his municipal practice, Alex defends municipalities and local agencies in a variety of state and federal litigation including

  • Defending state and federal constitutional challenges
  • Defending 42 U.S.C. § 1983 claims against law enforcement officers and other government officials
  • Defending state or federal challenges to municipalities’ local ordinances or regulations
  • Advising law enforcement agencies on public safety policy and legal training
  • Advising law enforcement agencies, merit commissions, safety boards, and other agencies on police and fire disciplinary matters

Alex also counsels  and helps both public and private sector employers in resolving employee problems, including:

  • Helping employers navigate state and federal employment law, including of Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act, the Family Medical Leave Act, and the Indiana Civil Rights Law
  • Advising employers and human resources professionals in resolving disciplinary problems
  • Reviewing and revising employee handbooks
  • Advising on employment policy matters
  • Conducting internal investigations of employee misconduct

Alex previously served as the Chief Litigation Counsel for the City of Indianapolis and legal adviser to the Chief of the Indianapolis Metropolitan Police Department. Before working for the City of Indianapolis, Alex served as a Deputy Prosecuting Attorney for Marion County, representing the State of Indiana in the Major Felony Division and the Strategic Narcotics Prosecution Division.

Alex is also a proud husband, father and woodworker.

Legal Work Highlights

Successfully defended the City of Hammond’s contractor licensing ordinances from constitutional challenge before the Northern District of Indiana and Seventh Circuit Court of Appeals

Successfully tried and defended the City of Indianapolis’s Amended Smoking Ordinance in a final injunction hearing before the Southern District of Indianapolis and appeal before the Seventh Circuit

Received defense verdict in federal employment law actions against City of Indianapolis alleging violations of Title VII and the Americans with Disabilities Act

Successfully argued for the Seventh Circuit to enter summary judgment for IMPD police detective in Brickely v. McComas after the detective had been accused of false arrest.

Defended numerous motions for preliminary injunctions filed against the City of Indianapolis, including a challenge to public bidding on towing services and a challenge to disbursement of settlement proceeds following an environmental cleanup.

Assisted in briefing and oral argument preparation for appellate counsel in Armour v. City of Indianapolis decided by the U.S. Supreme Court.

Defended numerous public entites, government officials, and private copanies at jury trials, bench trials, summary judgment and administrative hearings.
