Camille focuses her practice primarily on environmental litigation, as well as environmental due diligence in real estate and corporate transactions, remediation, counseling, and regulatory compliance. She has represented clients in an array of litigation matters involving environmental liabilities arising from corporate transactions, contractual indemnification, and related successor liability disputes; and in public and private party suits under the federal Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), the federal Resource Conservation and Recovery Act of 1976 (RCRA), the New Jersey Spill Compensation and Control Act (Spill Act), the Industrial Site Recovery Act (ISRA), and the New Jersey Landfill Closure Act, as well as under common law. She also has extensive experience assisting buyers, sellers, and developers in remediation activities, compliance, and environmental due diligence related to corporate and real estate transactions. She also has represented clients in matters related to odor and noise litigation arising from alleged complaints related to operations at manufacturing facilities in New Jersey. In addition, she has served as common and liaison counsel in complex multiparty litigation matters related to environmentally impaired properties.
Representation of clients in NJ Spill Act and CERCLA litigations and regulatory matters related to the Arthur Kill, Newark Bay, Lower Hackensack River, and Lower Passaic River.
Representation of a manufacturing company in a citizen suit and mediation related to RCRA, CERCLA, and common-law claims in New York State.
Representation of a specialty chemical company PRP in a government cost-recovery litigation under CERCLA and the Spill Act, and in private cost recovery litigation under the Spill Act and common law regarding a former industrial complex in northern New Jersey.
Representation of manufacturing clients in both litigation and compliance matters. Over more than two decades, Ms. Otero has closely coordinated with clients’ in-house legal counsel and outside environmental experts to assist clients in meeting their business needs. Ms. Otero has coordinated site investigations and cleanup of current and prior facilities; assisted in the closure and sale of industrial establishments; conducted due diligence in property transactions; and defended environmental litigation cases for these clients. She is currently involved in a complex multi-party litigation in federal court in the Eastern District of New York.
