Carrie has represented both public and private clients in complex matters regarding investigation and clean-up of contaminated sites in the Indiana State Clean-up Program, the Voluntary Remediation Program and the Independent Clean-up Program. She has defended clients in litigation brought by private entities pursuant to the Comprehensive Environmental Response and Liability Act (CERCLA), the Resource Conservation and Recovery Act (RCRA), Indiana’s Underground Storage Tank Act (USTA), Indiana’s Environmental Legal Action Act (ELA), and the Indiana Flood Control Act.
Carrie represents clients in state and federal court and before a broad range of administrative boards, including the Office of Environmental Adjudication and the Indiana Natural Resources Commission. She has successfully negotiated administrative agreed orders on behalf of clients.
Carrie has advised buyers, sellers and lenders in transactions involving the sale and acquisition of environmentally contaminated parcels and has assisted her clients in obtaining brownfields designations and comfort status letters.
She also advises insurance companies on such matters as coverage for claimed environmental contamination, including Superfund and brownfields sites.
Prior to joining Frost Brown Todd, Carrie served as the Environmental Policy Director to Indiana Governor Joe Kernan, providing technical and legal direction and consultation on matters involving environmental law to the Governor and staff. In addition, she previously served as Chief Legal Counsel to the Indiana Department of Natural Resources and was appointed by Indiana Governor Frank O’Bannon as a trustee for Natural Resource Damages in federal litigation involving the Clean Water Act (CWA). She has been named a Sagamore of the Wabash by both Governors.
Defense of private cost recovery actions involving gasoline service stations and dry cleaning facilities.
Defense of mineral and aggregate corporation in litigation involving floodway construction.
Assisted clients in acquisition, sale and financing of manufacturing facilities with recognized environmental conditions.
Represented insurers in state and federal litigation involving insurance coverage issues at manufactured gas plant sites, PCE/TCE contaminated locations, PCB and metals contaminated sites with a variety of prior industrial uses.
Represented former manufacturing owners of property in litigation involving redevelopment of urban brownfields property.
Advised manufacturers and developers regarding obtaining brownfields funding and comfort letters through direct work with the Indiana Finance Authority and the Indiana Department of Environmental Management.
Represented clients in obtaining site closure through use of recorded property use restrictions such as Environmental Restrictive Covenants and similar deed restrictions.
