Mr. Freilich focuses his practice in the areas of complex commercial and environmental litigation. He has extensive experience in the representation of potentially responsible parties in litigation and administrative actions initiated by the United States Environmental Protection Agency, state governmental authorities, and private parties brought under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), the Resource Conservation and Recovery Act (RCRA), state environmental statutes, and common law. Because of his experience and abilities in these areas, he has often been retained as common counsel or group counsel in such matters.
He has also represented defendants in toxic tort litigation involving claims by parties seeking damages for personal injuries and property damage resulting from exposure to hazardous substances and materials. Mr. Freilich also has extensive experience in the representation of policyholders in complex, multi-party insurance coverage litigation, primarily involving environmental insurance claims. In addition to his law practice, Mr. Freilich has experience with complex commercial matters, including antitrust, breach of contract, unfair competition, legal malpractice, and constitutional litigation.
