Biography

Kevin is a commercial litigator whose practice encompasses a range of complex commercial matters, with a particular focus in antitrust law. Drawing on his background in economics, Kevin represents clients in antitrust litigation, counsels on compliance matters arising in the restraint of trade and monopolization contexts, and guides clients through the merger review process under the Hart-Scott-Rodino Act. Outside of the antitrust realm, Kevin appears on behalf of corporations, individuals, and state agencies in federal and state courts, as well as in arbitrations and mediations, in contract disputes, fraud and RICO suits, and actions involving securities and ERISA law.

For the last ten months of Governor Christie’s Administration, Kevin served as Senior Counsel in the Office of Counsel to the Governor, where he advised on legal, legislative, and regulatory issues, interacted with legislators, and liaised with government affairs officers and other stakeholders. Kevin joined Gibbons from Paul, Weiss, Rifkind, Wharton & Garrison LLP, where he began his legal career. Prior to law school, he spent two years as a consultant at McKinsey & Company.

Antitrust

  • Prepared and submitted Hart-Scott-Rodino filings on behalf of buyers and sellers across various industries
  • Advised parties to merger transactions about clean team protocols and gun-jumping prohibitions
  • Counseled clients on issues related to no-poach and non-compete agreements, the Robinson-Patman Act, collaborations with competitors, minimum advertised price policies, and company-wide antitrust policies
  • Obtained dismissal of counterclaim alleging anticompetitive conduct against major grocery retailer

Commercial Litigation

  • Successful defense of a freight forwarder and eleven individuals in an action seeking $250 million in damages, based on claims of corporate raiding, misappropriation of trade secrets, tortious interference, and breach of fiduciary duties
  • Dismissal of federal RICO claims obtained on behalf of telecom services provider in S.D.N.Y. lawsuit brought by master agent, against whom we also brought a nine-count counterclaim
  • Representation of the New Jersey Sports & Exposition Authority in an emergent action in the Appellate Division, which affirmed the Authority’s approval of $1.1 billion in municipal bonds to finance development of the American Dream project in the Meadowlands
  • Dismissal obtained in multimillion-dollar lawsuit by healthcare consulting company and its co-founder, seeking unpaid commissions on theories of breach of contract, fraud, unjust enrichment, and conversion
  • Summary judgment obtained on behalf of the New Jersey Sports & Exposition Authority in a fraudulent concealment suit, which was affirmed on appeal
  • Dismissal obtained on behalf of a leading provider of VoIP services in a multimillion-dollar state court action alleging violations of state RICO and common law
  • Summary judgment obtained on behalf of a major ERISA benefits administrator and carrier in a provider dispute in D.N.J.
  • Summary judgment obtained on behalf of a major title insurance company in a class action complaint alleging violations of the Fair Debt Collection Practices Act in D.N.J.
  • Dismissal with prejudice obtained on behalf of same title insurance company in action by insured
  • Representation of the claimant and counterclaim respondent in an eight-figure arbitration concerning contractual earn-out and alleged failure to pay customs duties
