Our government contracting attorneys work with clients to maintain ongoing compliance with complex government contract requirements, including those imposed by the Federal Acquisition Regulations (FAR) and Agency FAR Supplements, as well Buy America Act requirements, International Traffic in Arms Regulations (ITAR), and various socio-economic programs. Our team has successfully defended our clients position in agency level bid protests, bid protests with the Government Accountability Office (GOA), and disputes in the Court of Federal Claims (COFC). We also have experience handling contracting matters beyond U.S. borders, including projects in Poland, France, Germany, the UK, Russia, Guam, Afghanistan, Kuwait, and Djibouti.

  • Defense and prosecution of lien, payment and performance claims arising from construction of interstate transmission lines.
  • Successfully defended SDVOSB general contractor in size and status protests in front of SBA OHA.
  • Obtained full claim value involving design-build Air Force hangar fire suppression system involving renovation project at Joint Base Andrews.
  • Successfully represented mechanical contractor in ASBCA challenging improper termination for default by Navy.
  • Obtained large settlement for subcontractor on multi-billion dollar Department of Energy (DOE) nuclear clean-up project against ENR Top Ten construction manager.
  • Advised environmental service contractor on issues related to alleged organizational conflict of interest related to DOE contract and prepared OCI mitigation plan to address same.
  • Defense and prosecution of claims on nuclear energy construction projects (reactor, fuel, and conversion facilities).
  • Successfully protested Air Force procurement action involving personal protective equipment for firefighters.
  • Represented a medical device developer regarding submission of proposal to Defense Advanced Research Project Agency (DARPA) in protection of intellectual property.
  • Prosecuted and intervened in numerous size challenges in SBA OHA.
  • Successfully protested multiple contract actions by DLA on behalf of parts manufacturer and distributor.
  • Assisted multiple clients form appropriate mentor-protégé agreements and related joint ventures.
  • Represented Air Force AbilityOne (formerly NISH) contractor on multiple Air Force contract dlaims involving Javits-Wagner-O’Day Act contracts for custodial services.
  • Represented a federal supply contractor during investigation and mandatory disclosure involving General Services Administration (GSA) Federal Supply Schedule (FSS) contract.
  • Represented a federal contractor in multiple bid protests involving Federal Emergency Management Agency (FEMA).
  • Defended qui tam case against an Army non-personal services contractor involving allegations of fraud in execution of contracts in Afghanistan.
  • Prosecuted and resolved a million-dollar claim against the United States Missile Defense Agency (MDA) involving environmental and geotechnical engineering investigation in Northern Poland.
  • Represented defense contractor in appeal from termination for default action involving supply contract with the United States Navy.
  • Represented Defense Supply Center Columbus (DSCC) contractor against allegations of false claims.
  • Represented ENR Top 10 contractor in preparation of claims involving Naval Facilities Command (NAVFAC) project in Northern Africa.
  • Conducted investigations for multiple clients related to potential mandatory disclosure issues and assist clients in preparing andy needed disclosures and negotiating with applicable government agencies regarding disclosures.
  • Successfully defended SDVOSB general contractor in size and status protests in front of SBA OHA.
  • Counseled construction material supplier in dispute involving questions under Truth In Negotiations Act.
  • Represented SDVOSB in REA and eventual claim arising out owner caused inefficiencies on hospital HVAC upgrade project.
  • Counseled numerous contractors regarding potential regulatory impact of various transactions which have included advice to environmental service contractor on impact of stock sale on 8(a) status, representation of SDVOSB architectural and engineering firm on alleged status issues raised by CVE arising out of its multiple locations, and advice to SDVOSB regarding potential impact of profit sharing plan on SDVOSB status.
  • Conducted due diligence related applicable FAR compliacne issues related to purchase of government contractors.
