The court of appeals reversed summary judgment in favor of our client, University Hospital, in this medical malpractice action. The court of appeals held that the hospital could be vicariously liable for the malpractice even though the alleged agent (doctor) was not immune from liability – a rule of law the Ohio Supreme Court subsequently rejected.
