Defended a claim for bad faith against our client, one of the largest scrap metal companies in the United States. The plaintiff alleged that our client was liable for bad faith for not promptly resolving the allegations it posed against our client for nuisance and trespass. As our client was not an insurer, and could not be liable for bad faith under Kentucky law, we moved for, an obtained, a dismissal from the case.
