Superior Steel, Inc., et al., v. The Ascent at Roebling’s Bridge, LLC., et al.
Frost Brown Todd represented a steel fabricator, Superior Steel of Knoxville, TN, and a steel erector, Ben Hur Construction of Cincinnati, OH, as plaintiffs in litigation against two defendants, a construction manager and an owner/developer, over unpaid extra work and retainage on a signature high-rise project in Northern Kentucky. The dispute over extra work involved several issues, including the completeness of the bid and construction drawings, the formation of the subcontract, and the effects of numerous design changes on highly complex structural connections. After a three-week jury trial, the jury deliberated for less than an hour and returned a verdict unanimously awarding our clients 100% of the damages sought.
